It’s no small irony that as Ohio lawmakers are pressing for regulations to ban private ownership of potentially dangerous wild animals, last week they made it easier to own a pit bull.
Since 1982, members of the breed have killed at least 10 Ohioans. Nationally, according to a 20-year study by the Centers for Disease Control and Prevention, pit bulls were responsible for nearly a third of the 238 recorded fatal dog attacks.
Proponents were tenacious, however, in lobbying to end Ohio’s 25-year practice of automatically labeling the breed as “vicious”; owners no longer will be required to routinely fence, muzzle or chain pit bulls and carry $100,000 in liability insurance.
House Bill 14 is disappointing on a number of fronts: It caves to emotion and ignores data. And it puts at risk Ohioans who, if mauled, are likely to incur enormous medical bills. This is a classic case of lawmakers serving a special interest rather than the public interest.
Yet Sen. Mark Wagoner, R-Toledo, called Ohio’s old law “canine profiling,” as if dogs had a constitutional right to due process and were singled out because of mere prejudice, rather than facts. This is factually misinformed, likely explaining why so many who voted against the bill represent urban areas, where pit bulls are a serious problem.
The new law, however, does include some redeeming changes that ought to strengthen Ohio’s broader vicious dog law. Dog wardens will get more tools, including increased fees, to deal with any dog that menaces or attacks. And new classifications will ratchet up restrictions on dogs branded as a “nuisance,” “dangerous” or “vicious.”
Toledo-area Rep. Barbara Sears, who sponsored the bill, also said the change in state law will not compel communities to change their ordinances restricting pit bulls. Her senior legislative aide, Joseph Russell, said they wanted to make certain as the law was being drafted that “it respects home rule.” That’s good, because previous state laws have run roughshod over local control. In Columbus, for instance, state law invalidated city laws to prevent guns in parks and to more tightly regulate predatory tow-truck drivers who whisked away cars and charged exorbitant fees.
