Lying, unlicenced driver headed to jail
When Todd Parisee-Enair was involved in a motor vehicle accident with his girlfriend's car on Dominion Drive in Val Therese last April, he had to think fast.
That was because the 23-year-old Levack man did not have a driver's licence.
So, when Parisee-Enair called Greater Sudbury Police to report the accident, he said his girlfriend was the one behind the wheel and gave a signed statement about what had happened.
On Friday, Parisee-Enair pleaded guilty to obstructing police and received a 30-day weekend jail term and one year of probation.
"Not only did you tell the police you were not the driver, but you signed a statement saying that was the case," Ontario Court Justice Randall Lalande told Parisee-Enair. "You implicated her. There was no insurance. She wasn't allowed to let a non-driver drive her vehicle. There could have been serious consequences due to an absence of insurance ...
"You have to talk to yourself about not lying to people. It's the third time in three years being convicted for obstruction-related matters."
The court heard the accident occurred about 6:45 p.m. April 16 at the Dominion Drive/Municipal Road 80 intersection, in which Parisee-Enair was driving carelessly.
When he called police, Parisee-Enair said it was his girlfriend who had been driving and that her vehicle had been struck by another driver.
Defence lawyer Gary McMahon said his client was just trying to protect his girlfriend.
"He was not allowed to drive the vehicle," McMahon told the court. "He was trying to protect his girlfriend for insurance purposes. He did not have a licence at the time."
McMahon asked for a 60-day conditional (house arrest) sentence or 30-day intermittent sentence so that Parisee-Enair could complete the balance of his upgrading courses and enroll in the chef program at Cambrian College in the fall.
Assistant Crown attorney Philip Zylberberg asked for 30 days straight jail time, citing Parisee-Enair's criminal record. Not only was Parisee-Enair convicted in September 2009 of personation with intent and given a fine, said Zylberberg, but in August 2010, he was convicted of the same offence as well as obstructing a peace officer, and was given a 30-day conditional sentence.
