Oct. 6 (Reuters) - A clearing in a format called triangular standard International Swaps & Derivatives Association agreement is not enforceable in bankruptcy, according to a decision of October 4 U.S. Bankruptcy Judge James M.Peck in the liquidation of the brokerage subsidiary of Lehman Brothers Holdings Inc.

Peck said the bankruptcy law requires mutuality, meaning that compensation exists only between the same two companies. Compensation for debt recovery to an affiliate is not authorized by the language of the statute, Peck said.
While a triangular compensation may be permitted by state law, it does not bankrupt because "Bankruptcy Code imposes its own stringent requirements," said Peck. Peck ruled parts can not create mutuality in the contract.
