Over the last 10 years, eight unions that now represent more than 2,000 Toledo municipal employees have filed 3,115 grievances against the city. Officials say the grievances represent a costly reality in their dealings with the public employee unions. If Ohio voters approved Issue 2 on Nov. 8, those employees would have less recourse in their dealings with the city, and the city could be spared some of the expense in dealing with such issues. Here, we look at a sampling of the types of grievances filed against the city since 2001. ◾ Claims that management performed work that should have been done by a union employee. Dec. 16, 2010: Dave Fleck, a fleet and facilities employee represented by Local 7, grieved that Tim Burns, a manager, ordered equipment accessories. "I was not offered or included in any of these projects," Mr. Fleck wrote. He asked for back pay and for the practice to stop. The city initially declined the grievance, but it was resolved after a hearing two months later. The employee received two hours of compensatory time as a result of a nonunion member doing his work. ◾ Claims that management used subcontractors to perform work that is in a specific union's jurisdiction. RELATED STORY: Nearby cities post much lower grievance rates than Toledo Jan. 7, 2010: Local 7 said it did not approve the use of seasonal or temporary employees to work on the city's transition to a new finance computer system, known as ERP. It asked the city to remove the employees and give the work back to Local 7 employees, as well as to pay those Local 7 employees for the time they missed on the project. The grievance was flatly denied, citing "management rights." It was appealed to the next step, which brought it to the city's human resources department -- which also denied the grievance. The temporary subcontracted employees remained working on the project only, but the city agreed that they would not do any "Local 7 work.
