Then he got another one.


Each statement asked him for a different payment due on Jan. 1.

The first statement contained the amount agreed to in his modification: $5,267. But it included mysterious "fees due" of $3,555, his attorney said. The second statement, dated Dec. 19, sought a payment of $5,797. It had an inflated monthly escrow amount.

"Obviously, the two statements conflict with one another and neither agrees with the terms of the modification agreement," Galanida's lawyer, Kelly Harpster, wrote Monday in a letter to the bank.

Harpster sent the bank a Qualified Written Request under the Real Estate Settlement Procedures Act. The federal law gives the bank 60 days to correct Galanida's account. It also prohibits the bank from reporting Galanida to credit agencies as overdue.

Harpster said the bank corrected the statements this week.

When we first reported Galanida's tale, some readers couldn't believe it. His mother, Joanie Ahrenkiel, who oversees his affairs, said she had withheld payment in early 2009, insisting a discrepancy had arisen in his billing statement. It arose, she said, after Bank of America took over Countrywide Home Loans.
